PSHARE Users’ Agreement and Privacy Policy
Special Reminder
"Pshare" is an intelligent parking app developed and operated by Hangzhou PSHARE NETWORK Technology Co., Ltd. (hereinafter referred to as "PSHARE NETWORK"). The main functions include but are not limited to: users can control one or more Bluetooth parking locks and can share them with other users according to the time period. Please read this user agreement (hereinafter referred to as the "agreement") carefully to ensure that you fully understand the terms of this agreement. Your registration, login and use will be deemed as acceptance of this agreement, and you agree to be bound by the terms of this agreement.
1、Account Registration
（1）Users need to register a "pshare" account before using this service. "Pshare" account should be registered with mobile phone number binding. Please use the mobile phone number that has not been bound with "pshare" account. The way of account registration and binding can be changed according to the needs of users or products without prior notice to users.
（2）As the "pshare" account contains the mobile phone binding registration method, you agree that PSHARE will use the mobile phone number and other information provided by you for registration.
（3）When you upload a phone number to our Service, we will send an SMS message by https://api.ringcaptcha.com or place a phone call to the phone number to verify whether the number is a live number, and that it belongs to you. We will also store those phone numbers you upload to the Service in a hashed or encrypted manner for fraud and service abuse prevention, debugging purposes. Both PSAHRE NETWORK and RINGCAPCHA accept the same privacy policy for its service hereinafter.
2、Service Content
（1）The specific content of this service is provided by PSHARE NETWORK according to the actual situation, including but not limited to the rise/fall control of the Bluetooth parking lock owned by the user, and can be shared with other users according to the time period.
（2）The service provided by PSHARE NETWORK is free of charge.
3、Privacy Protection
（1）PSHARE NETWORK is committed to protecting the security of your personal information. We use a variety of industry-standard security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while PSHARE NETWORK uses reasonable efforts to protect your personal information, PSHARE NETWORK cannot guarantee its absolute security.
（2）When you use our Service, some information is automatically collected. PSHARE NETWORK collect the following information for fraud and service abuse prevention, debugging purposes and to identify bots and other automatic scripts that may be attempting to gain access to our systems:
• Cookies. Like madny online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience.
• Log Files. We gather certain information automatically and store it in log files. This information includes IP addresses, browser type, referring/exit pages, operating systems, date/time stamp, Internet Service Provider (ISP), browser language and your general geographic location information.
• Mobile Services. We may also collect the following non-personal information from your mobile device when you use our Service: mobile device identification number and model software version, device carrier, device language, and your geographic location.
（3）PSHARE NETWORK use personal information collected through our Sites for purposes described in this Policy or disclosed to you on our Sites or in connection with our services. For example, we may use your information to:
• operate and improve our Sites, products, and services;
• understand you and your preferences to enhance your experience and enjoyment using our Sites, products, and services;
• respond to your comments and questions and provide customer service; and
• Provide and deliver products and services you request.
We may create anonymized data records from personal information by excluding information (such as your name) that makes the data personally identifiable to you. We use this anonymized data to analyze request and usage patterns so that we may enhance the content of our products and services and improve user experience. We reserve the right to use anonymized data for any purpose and to disclose anonymized data to third parties in our sole discretion.
（4）PSHARE NETWORK disclose your personal information as described below and as described elsewhere in this Policy:
• with your consent;
• with third party vendors, consultants, and other service providers who work for us and need access to your information to do that work;
• to (i) comply with laws or to respond to lawful requests and legal process, (ii) to protect the rights and property of Pshare and our agents, customers, members, and others including to enforce our agreements, policies, and terms of use, or (iii) in an emergency to protect the personal safety of Pshare, its customers, or any person; and
• in connection with or during negotiation of any merger, financing, acquisition, or dissolution, transaction, or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets to another company. In the event of an insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the personal information collected by us and will assume the rights and obligations regarding your personal information as described in this Policy.
4、Usage Rules
The services provided by PSHARE NETWORK may include advertisements. Users agree to display advertisements provided by PSHARE NETWORK and third-party suppliers and partners during the use process. Unless otherwise specified by laws and regulations, users shall be responsible for the transactions conducted in accordance with the advertising information, and PSHARE NETWORK shall not be liable for any loss or damage suffered by users due to the transactions conducted in accordance with the advertising information or the content provided by the above-mentioned advertisers.
5、Account Management
（1）The ownership of the "pshare" account belongs to PSHARE NETWORK. After completing the registration application procedures, the user can obtain the right to use the "pshare" account. The right to use the account belongs to the initial applicant, and it is prohibited to donate, borrow, rent, transfer or sell. PSHARE NETWORK has the right to reclaim the user's "pshare" account number due to business needs.
（2）Users can change and delete their personal data in the" pshare "account, but it should be noted that users should bear the risk.
（3）The user is responsible for keeping the security of the registered account information and account password properly. The user may suffer from theft of the account number or password due to improper storage, and the responsibility shall be borne by the user. Users need to bear legal responsibility for the behavior under the registered account and password. The user agrees not to use the account or password of other users under any circumstances. When the user suspects that other people use his account or password, the user agrees to inform PSHARE NETWORK immediately.
（4）The user shall abide by the terms of this Agreement and use the service correctly and properly. If the user violates any of the terms of this agreement, PSHARE NETWORK has the right to interrupt or terminate the service to the "pshare" account of the defaulting user according to the agreement after notifying the user. At the same time, PSHARE NETWORK reserves the right to take back the "pshare" account and user name at any time.
（5）The ownership of the "pshare" account belongs to PSHARE NETWORK. After completing the registration application procedures, the user can obtain the right to use the "pshare" account. The right to use the account belongs to the initial applicant, and it is prohibited to donate, borrow, rent, transfer or sell.
6、Intellectual Property Declaration
（1）In addition to the intellectual property rights related to advertising in this service, the intellectual property rights of the content (including but not limited to web pages, text, pictures, audio, video, charts, etc.) provided by PSHARE NETWORK in this service belong to PSHARE NETWORK, except that users have legally obtained intellectual property rights for the content they publish before using the service.
（2）Unless otherwise stated, the copyright, patent right and other intellectual property rights of the software relied on by PSHARE NETWORK to provide this service belong to PSHARE NETWORK.
（3）The copyright or trademark rights of the graphics, words or their composition involved in the service, as well as other PSHARE NETWORK signs, product and service names (hereinafter referred to as " PSHARE NETWORK LOGO") shall be owned by PSHARE NETWORK. Without the prior written consent of PSHARE NETWORK, the user shall not display or use the PSHARE NETWORK LOGO in any way or make any other treatment, and shall not indicate to others that the user has the right to display, use, or otherwise have the right to handle the PSHARE NETWORK LOGO.
（4）The intellectual property rights of the above and any other related advertisers shall be protected by law. Users shall not use or create derivative works in any form without the written permission of PSHARE NETWORK or related advertisers.
7、Force Majeure and Other Exemptions
（1）The user understands and confirms that in the process of using the service, it may encounter force majeure and other risk factors, which may cause the service to be interrupted. Force majeure refers to the objective events that cannot be foreseen, overcome and avoided, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, and social events such as war, turmoil, and government actions. In case of any of the above situations, PSHARE NETWORK will try to cooperate with relevant units as soon as possible and repair them in a timely manner. However, any loss caused to users or third parties shall be exempted from liability within the scope permitted by law.
（2）Like most Internet services, this service is affected by, but not limited to, user reasons, network service quality, social environment and other factors, and may be invaded by various security issues, such as other people's use of user's information to cause real-life harassment; users download and install other software or visit other websites contain "Trojan horse" and other viruses, It threatens the security of user's computer information and data, and then affects the normal use of this service. Users should strengthen the awareness of information security and user data protection, and pay attention to strengthen password protection to avoid loss and harassment.
（3）The user understands and confirms that there is a risk of service interruption or failure to meet the user's requirements due to force majeure, computer virus or hacker attack, system instability, user's location, user's shutdown, and any other technical, Internet, communication line reasons, etc., PSHARE NETWORK will not be responsible for any loss of the user or the third party.
（4）The user understands and confirms that the "pshare" platform or related equipment needs to be overhauled or maintained regularly or irregularly. If the service is interrupted within a reasonable time due to such circumstances, PSHARE NETWORK does not need to bear any responsibility for this.
（5）The user understands and confirms that for the quality defects of the following products or services provided by PSHARE NETWORK to users and any losses caused by them, PSHARE NETWORK shall not be liable for: a. the services provided free of charge by PSHARE NETWORK to users; b. any products or services presented by PSHARE NETWORK to users.
（6）In any case PSHARE NETWORK shall not be liable for any indirect, consequential, punitive, incidental, special or punitive damages, including loss of profits suffered by users due to the use of "pshare" or the service (even if PSHARE NETWORK has been informed of the possibility of such loss). Notwithstanding any provision to the contrary contained in this agreement, the total liability of PSHARE NETWORK to the user, for whatever reason or manner of conduct, shall not exceed the fee (if any) paid by the user to PSHARE NETWORK for the use of the services provided by PSHARE NETWORK.
8、Others
（1）PSHARE NETWORK solemnly reminds users to pay attention to the terms of exempting PSHARE NETWORK responsibility and restricting users' rights in this agreement. Users are requested to read carefully and consider risks independently. Minors should read this agreement in the company of their legal guardians.
（2）The validity, interpretation and dispute settlement of this Agreement shall be governed by the laws of the people's Republic of China. In case of any dispute or dispute between the user and PSHARE NETWORK, it shall be settled through friendly negotiation. If the negotiation fails, the user agrees to submit the dispute or dispute to the people's court with jurisdiction in the place where PSHARE NETWORK is located.
（3）Any provision of this Agreement shall be invalid or unenforceable for any reason, and the remaining provisions shall remain valid and binding on both parties.
